Please read these Terms of Service ("Terms") carefully before using Affilio AI (the "Service") operated by Affilio AI ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part, you may not use our Service.

1. Eligibility

You must be at least 13 years old to use Affilio AI. By using the Service, you represent that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Account Registration

You must create an account to access most features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately at [email protected] if you suspect unauthorized access. We reserve the right to terminate accounts that violate these Terms.

3. Subscriptions & Billing

Affilio AI offers free and paid subscription plans. Paid plans are billed on a recurring basis (monthly or annually) via Stripe. By subscribing to a paid plan, you authorize us to charge the applicable fees to your payment method.

• Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time.
• Refunds: Refunds are issued at our sole discretion. If you believe you were charged in error, contact us within 7 days.
• Price changes: We may change subscription prices with 30 days' prior notice. Continued use after the price change constitutes acceptance.

4. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, abusive, defamatory, or fraudulent
• Violate any applicable laws or regulations, including FTC affiliate disclosure requirements
• Impersonate any person or entity
• Spam, phish, or engage in deceptive marketing practices
• Reverse-engineer, scrape, or attempt to extract the underlying AI models or platform infrastructure
• Share your account credentials with others or resell access to the Service
• Upload or transmit malware, viruses, or malicious code

5. AI-Generated Content

Affilio AI uses OpenAI's API to generate content. You are solely responsible for reviewing, editing, and using any AI-generated content. We do not guarantee the accuracy, legality, or suitability of AI outputs. You must:

• Review AI-generated content before publishing
• Ensure affiliate disclosures comply with applicable laws (e.g., FTC guidelines)
• Not use AI outputs to make false or misleading claims about products

You own the content you create using Affilio AI, subject to OpenAI's usage policies.

6. Intellectual Property

The Affilio AI platform, including its logo, design, features, and underlying technology, is owned by Affilio AI and protected by intellectual property laws. You may not copy, reproduce, modify, or distribute any part of the Service without our prior written consent.

You retain ownership of content you input into and generate through the Service.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate or suitable for any purpose. Use of the Service is at your own risk.

8. Limitation of Liability

To the fullest extent permitted by law, Affilio AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising from your use of or inability to use the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

9. Termination

We may suspend or terminate your account at any time if you violate these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including ownership, warranty disclaimers, and liability limitations.

10. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice in the app. Continued use of the Service after changes take effect constitutes your acceptance of the new Terms.
